Common property of spouses The topic of my thesis is common property of spouses. It is an institute of civil law governed by the provisions of Civil Code. I have chosen this particular topic because I am interested in it and in civil law in general and I find it very important. Future spouses should be aware of the legislation that regulates the property rights and duties between them. Arranging the property relations before the marriage can prevent future conflicts. The work deals with the current legislation governing the institute of common property of spouses in relation with the judicial decisions. The goal of my thesis was to explore the current legislation, to point out some of the disputable questions and to seek to define several legal terms that are not clear at the first sight. The work also briefly deals with the project of the new Civil Code. The thesis is composed of seven chapters. Chapter one is introductory. It defines the term of common property of spouses and briefly deals with the former institute of equal ownership of spouses. Chapter two is divided into two subchapters. The first one describes the establishment of the common property of spouses. The other deals with its object and contains three parts. This rigorous thesis deals comprehensibly with issues related to the community property. The rigorous thesis is divided into four parts. The first part outlines a historical development of the institute of community property in our territory from the time of ABGB. The second part deals with current issues of proprietary relationships between spouses. The third part deals with the issue of housing and the matter of regulation on the community property and the insolvency procedure. The last part of the thesis outlines a question of the proprietary relationships between spouses in the new prepared Civil Code. The rigorous thesis was developed using legislation as at 1 January 2010, current judicature, professional expert articles and professional legal papers.

Matrimonial property and obligations of the spouse This thesis analyses regulation of matrimonial property with an emphasis on its administration, scope and settlement. The main focus of this thesis is to analyse actual statutory regulation in context of actual case law of Czech Supreme Court, with special focus on institute of invalidity of juridical act, disputes in matters of administration and scope of matrimonial property as well as on intertemporality issue in matrimonial property law. Subject of this thesis is related to current development of Czech Supreme Court case law. Aside from introduction and conclusion, the thesis consists of five main chapters. In second chapter, the term and concept of matrimonial property in context of current statutory regulation and regulation of Civil Code 40/1964. Coll. is defined. Third chapter analyses matrimonial property regimes - statutory regime, contractual regime and regime established by a court decision with focus on detailed specification of scope in the statutory regime, with legislative proposal de lege ferenda. Final part of this chapter gives attention to disputes about the scope of matrimonial property with focus on immovables. Práce popisuje účinky insolvenčního řízení na majetek v SJM v případě úpadku jednoho nebo obou manželů, a to s přihlédnutím k aktuální odborné literatuře a judikatuře. Práce popisuje jednotlivé způsoby řešení úpadku manželů (zejména konkurs a oddlužení, event. reorganizace u OSVČ), vč. procesních otázek souvisejících s podáním insolvenčního návrhu a návrhu na oddlužení. Práce dále popisuje postup při uplatnění pohledávky náležející do SJM, jestliže jsou manželé v postavení věřitelů.
